PARMER COUNTRY, Texas (June 15, 2016) — A judge in the 287th Judicial District Court in Parmer County has granted summary judgment to Michelin in a product liability case.
Charles Jackson was killed in a rollover accident in Bovina, Texas, in April 2014, according to a Michelin press release. Jackson's son filed suit, claiming a Michelin tire on the vehicle was defective.
The judge in the case, however, said there was no evidence of a defect, and also denied the plaintiff's claim that Michelin had a duty to warn consumers about the use of an 11-year-old tire.
“The court's decision comes on the heels of several other recent successes for Michelin in product liability lawsuits, including a unanimous defense verdict in Arizona in November 2015 and two other case dismissals in Texas earlier this year,” Michelin said in its press release.
“The company values the court's decision in this case and believes in the high quality of its tires and the rigorous efforts it takes to ensure the safety of its product,” the tire maker said.
