LOS ANGELES (Oct. 1, 2013) — Toyota Motor Corp. tentatively lost a bid recently to get a court to throw out a lawsuit claiming one of its vehicles suddenly accelerated and caused an accident that left a woman severely injured.
Bloomberg reported that U.S. District Judge James V. Selna in Santa Ana, Calif., on Sept. 30 issued a tentative ruling denying Toyota's request for a summary judgment in the lawsuit brought by the estate of Ida St. John, finding sufficient evidence for the case to go forward. The ruling, if made final, would mean Ms. St. John's case will begin trial Nov. 4, the first of the federal claims consolidated before Judge Selna to reach a jury.
Ms. St. John, then 83, was injured when her 2005 Toyota Camry crashed in April 2009 in Columbus, Ga., according to Bloomberg. She died after the accident and her grandson is pursuing the lawsuit. He doesn't claim the accident caused the death.
