LINCOLN, Neb. (Aug. 30, 2004) — The Nebraska Supreme Court is scheduled to hear oral arguments Sept. 9 in a case involving the Nebraska Department of Environmental Quality and a Wisner, Neb., tire recycler that claims the DEQ is arbitrarily interfering with its business.
The DEQ revoked the operating permit of Central States Tire Recycling of Nebraska because it did not seek agency approval to install its Enviro-Block scrap tire bales in a vacant lot slated for commercial development. Central States sued the DEQ, claiming the agency had violated its right of due process and made arbitrary decisions that hurt the company.
The Supreme Court should rule on the case before the end of the year, according to John D. Feller, Central States' attorney.
