CHICAGO (May 9, 2002)—Plaintiffs' attorneys representing millions of Ford Explorer and Firestone tire owners in a non-injury class action have filed a motion for rehearing in the U.S. Seventh Circuit Court of Appeals.
They seek to overturn the court's May 2 rejection of an Indianapolis federal judge's certification of the action. There are plenty of state class-action suits ready to go if the federal action isn't approved, said attorney Don Barrett of Lexington, Miss.
“You know the old saying, 'Be careful what you wish for, because you may get it,'” Mr. Barrett said. “Firestone is out of the frying pan and in the fire now.”
